These Terms and Conditions (“Terms”) apply to registrations for free events organised by the University of the Arts London (“UAL”) through our events management system, Fonteva Events (“Fonteva”). Please read them carefully before you register. These Terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. By registering for a place at one of our events, either virtual or in-person, you accept these Terms and agree to comply with them.
1. Definitions
I acknowledge that in these Terms, the following expressions will have the following meanings:
“Booking Form” means the online form which you complete to request a place on the Event;
“Confirmation” means the email sent to you via Fonteva to confirm your booking for the Event;
"Event" means either the virtual or in person event which you request a place for by submitting a Booking Form;
"Event Materials" means any print or online materials, presentation slides, UAL’s name and logo, and any photos or recordings of the Event;
“Event Outside of Our Control” means an event or circumstance beyond our reasonable control, including but not limited to
- a. strikes, lock-outs or other industrial action by third parties;
- b. strikes, lock-outs or other industrial action by our employees;
- c. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, adverse weather, subsidence, or other natural disaster or “act of god”;
- d. failure of public or private telecommunications networks; and/or pandemic, epidemic and any related restrictions or requirements that might be imposed by any Government or relevant authority, and will include, for example, any disruption caused as a result of COVID-19.
"Website" means the webpage where the Event is listed.
2. The event
2.1 The Event is organised and managed by UAL through the Fonteva events management system. References to ‘UAL’ include its constituent Colleges known as Camberwell College of Arts, Central Saint Martins, Chelsea College of Arts, London College of Communication, London College of Fashion and Wimbledon College of Arts. UAL has charitable status as a higher education corporation and its registered office is 272 High Holborn, London WC1V 7EY.
2.2 The Event is free.
2.3 On submitting your Booking Form you will receive Confirmation of your booking immediately via Fonteva. A legally binding contract between you and us will be formed at the point Confirmation is issued.
2.4 All Events are subject to availability. If the Event is fully booked and there is a waiting list, we will contact you if a place becomes available.
2.5 The Event will be delivered on the date and at the time and location stated on the Website.
3. Your responsibilities
3.1 You must tell us as soon as possible about any changes to the information which you provide on the Booking Form either by contacting us using the details provided on the Website or through your Fonteva account (if you have one). If you make a significant change, we may cancel your place on the Event.
3.2 You must not make any recording of the Event without our prior written consent.
3.3 You agree to behave appropriately at the Event and follow the instructions of our staff. We reserve the right to exclude anyone who behaves rudely, dangerously or inappropriately, and refuse entry into future events at UAL’s absolute discretion. For virtual Events, you are expected to adhere to our Virtual Community Code of Conduct.
3.4 Before submitting a Booking Form for a virtual Event, you must have the required equipment, software and sufficient network access to attend the Event.
4. Changes to the event and cancellation
4.1 We reserve the right to make changes or to cancel the Event at any time:
- 4.1.1. where any speakers, contributors and/or content become unavailable; or
- 4.1.2. for any Event Outside of Our Control.
4.2 Where we cancel or change the Event pursuant to clause 4.1 we will update the Website and contact you as soon as possible.
4.3 We shall not be liable to you for any travel, accommodation or other costs and expenses which you may incur if we cancel, relocate or otherwise change the Event.
4.4 If you need to cancel your booking you can either contact us using the details provided on the Website or using your Fonteva account (if you have one).
5. Event materials
5.1 All intellectual property rights in the Event Materials shall belong to UAL and/or any third party contributors to the Event. You do not have the right to use, copy, distribute or exploit the Event Materials without our prior written consent of UAL or the relevant third party. In particular, you may not use the Event Materials in a way that may infringe third party rights or bring UAL or any third party organisation into disrepute.
5.2 You acknowledge that UAL does not guarantee the quality or accuracy of any content or information provided to you during the Event or of any Event Materials.
6. Use of information
6.1 The personal data and contact information provided in the Booking Form will only be used for contacting you in relation to the Event you have registered for, unless you have requested to receive other communications from us, such as information about future events. This information will be processed and stored as outlined in our privacy policy.
6.2 Where we have organised the Event on behalf of a third party or partner, we may need to share your information with that third party organisation for the purposes of that Event only. If this is the case, you will be asked to confirm that you agree to your personal data being shared with that named party at the time of booking.
7. Exclusion of liability
7.1 All implied warranties are excluded to the fullest extent lawfully permitted.
7.2 Where the Event is to be held virtually, UAL will use reasonable endeavours to make the Event available but cannot guarantee uninterrupted, timely or error-free availability or that defects will be corrected. UAL will not be held responsible for any technical problems you encounter during a virtual Event.
7.3 Except in respect of death or personal injury caused by our negligence, for fraud and except as otherwise specifically provided by law, we will not be liable for any claim to the extent that the same is or can be characterised as a claim for (or arising from): loss of revenue or profits; loss of anticipated savings; loss of goodwill or injury to reputation; loss of business opportunity; loss of data; loss of or damage to property or personal belongings; losses suffered by third parties (whether such losses are direct or indirect); or indirect, consequential or special loss or damage, regardless of the form of action, whether in contract, strict liability or tort (including negligence), and howsoever arising.
8. Miscellaneous
8.1 The Booking Form and these Terms represent the entire agreement between you and us in relation to the Event. You acknowledge that you have not relied on any representation or warranty other than as expressly set out in the Booking Form and these Terms.
8.2 We reserve the right to amend these Terms from time to time. However, you will be subject to the terms and conditions in force at the time you submit your Booking Form which will be available on the Website. The latest version will be available on UAL’s website.
8.3 No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
8.4 If any provision in these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions (and the remainder of the provision in question) shall be unaffected.
8.5 No person other than you and UAL shall have the right to enforce these Terms.
8.6 These Terms are governed by English law and you submit to the exclusive jurisdiction of the English courts. Nothing in this clause shall prevent or restrict UAL from pursuing any action against you in any court of competent jurisdiction.
